A Path to Save Blockbuster?

Is copying Redbox’s strategy a way for Blockbuster to survive? I’m beginning to think so.

Earlier this week, I rented from a Redbox for the first time. I have walked by these kiosks in our area for well over a year now, and in recent months they’ve become quite numerous — Redbox lists 19 of them within 10 miles of my house alone. The allure of a movie for just a buck a night is just too good of a deal to pass up.

While entering my selections into the kiosk — Star Trek and Angels & Demons — I couldn’t help but wonder why Blockbuster wasn’t doing the same thing. Heck, it costs you $5 to rent these same movies at their stores no matter whether you return them the next day or however long your local store allows the movies to be out.

It’s for this reason why Blockbuster is struggling. In this new world, it no longer is worthwhile to have a storefront because of the overhead costs. Think about it. Netflix has considerably less infrastructure costs because all its business is online and only needs shipping warehouses to serve its customers; Redbox has even less overhead since it essentially freeloads off the locations where its kiosks sit.

There’s just no way that the company can be on a level playing field with its competitors because of this. Tuesday’s news of the company partnering with NCR to place 200 “Blockbuster Express” kiosks in Duane Reade Drugstores across New York City could arguably be Blockbuster’s path to salvation.

When the company is done, about 2,500 kiosks will be up and running around the country. Each will hold about 900 DVDs, which will give the movie retailer an opportunity to offer a wider selection than that of Redbox, which can only hold about 500 discs.

As the company moves to this system, it will allow Blockbuster to continue closing down its retail locations, which have become its Achilles heel. This will stink for those employees that could soon find themselves out of a job, but its just a reality of our modern digital economy.

It’s going to be very interesting to see how Redbox responds. Blockbuster eliminated its competition by simply being able to offer a broader selection of movies than its smaller competitors, and now the company that arguably pioneered the movie rental kiosk finds itself in the same situation.

One thing it has so far as an advantage over Blockbuster is scale — some 17,500 kiosks are located in McDonald’s, Wal Marts, Walgreens, and other grocery and drug stores around the country. Blockbuster will need to quickly ramp up to legitimately compete.

Apple vs. Psystar is Not Over

Today Apple reached a deal with Mac clone maker Psystar ahead of a federal court case that could have granted Apple an injunction forbidding Psystar from preinstalling Apple’s OS X software on its products. However, the settlement was very specific to what it actually settled, which means the companies will continue the legal wrangling.

Psystar is paying Apple $2.7M in damages to avoid a trial. That takes the immediate threat of a federal injunction off the table, but the overarching dispute remains. It is also likely that Psystar, which recently emerged from bankruptcy, won’t pay the settlement until its appeals have been exhausted.

I have not seen the terms of the agreement, and wonder whether any of the claims were dismissed without prejudice. Apple charged Pystar of breach of contract, copyright infringement, and violating the Digital Millenium Copyright Act; Psystar made counterclaims of copyright misuse and unenforceability.

“It looks like it isn’t really a settlement as much as a narrowing of the issues in dispute,” said Mark A. Lemley, director of Stanford Law School’s Program in Law, Science, and Technology, in reference to today’s agreement. “The issues that are outstanding are (1) the core legal issues, which are on appeal, and (2) whether the injunction would apply to future Psystar products,” he added in a follow up e-mail.

Many issues (and the “what is the point” question) remained unsettled, and will be weighed by the United States District Court for the Southern District of Florida. Apple has also not yet taken any action against Psystar’s Rebel EFI software, which allows end users to install copies of OS X on unauthorized generic hardware.

This convoluted, bumpy ride will continue. If you want a Mac, buy it from Apple, or, if so inclined, check in with the Hackintosh community.

What the World’s Been Searching For in 2009

It’s become a tradition for the major search engines to release year-end summaries of what their users have been searching for–and for reasons unknown to me, all of them unveil these lists on December 1st, so they really cover 11/12th of the year.

Game Console Buying Guide 2009: How to Choose Wisely

I’ll talk about video games to anyone who can stand to listen, but I’m always surprised when someone asks me which of the three current home consoles is the best. Choosing a video game system isn’t about superiority — sorry fanboys — it’s about having fun with your $300 to $500 investment instead of using it as a dust magnet. With Sony, Microsoft and Nintendo all cutting prices, it’s a pretty good time to talk about buying a Playstation 3, an Xbox 360 or a Wii. Goodbye, Gears (Sniff!)

Earlier today, I wrote about the almost-here beta of Google’s Chrome browser for OS X, and mentioned that it doesn’t support Google’s Gears technology for making Web services such as Gmail, Google Docs, and Remember the Milk work without the Web. Turns out the bad news may have less to do with Chrome and more to do with Gears.

The L.A. Times’ Mark Milian has blogged about the lack of Gears in Mac Chrome, and the fact that the upcoming, still-unfinished HTML5 standard will feature Gears-like offline features. Milian got a quote from an unnamed Google spokesman:

We are excited that much of the technology in Gears, including offline support and geolocation APIs, are being incorporated into the HTML5 spec as an open standard supported across browsers, and see that as the logical next step for developers looking to include these features in their websites.

Nokia N900 Plays NES Emulators? You Never Heard That.

The first rule of classic console emulation is that you don’t talk about classic console emulation, but that’s exactly what Nokia did to promote its new N900 smartphone, and now the interest of Nintendo’s legal team is piqued.

According to The Independent, Nokia posted a video clip of the N900 running Super Mario World and Super Mario Bros. 3, among other classics, using emulators. The official video and accompanying Nokia Conversations blog post have since been removed, but I’ve found what appears to be the same video here, for now. It mentions how some emulators let you tweak the N900’s controls for the best set-up, while others even take advantage of the phone’s touch and tilt capabilities.

Department of Misleading Headlines

Scott Moritz, at TheStreet.com:

Um, read the story, and you’ll find it presents no evidence that Apple is contemplating a T-Mobile deal. All you get is an analyst speculating that Verizon isn’t going to get the iPhone soon, and speculating that if Apple wants to end AT&T’s iPhone exclusivity it might logically cut a deal with T-Mobile. But it’s all guesswork.

The analyst says that he expects that a Verizon iPhone will appear only in 2011, and that it’ll use a 4G LTE data connection rather than Verizon’s current EVDO network. Sounds logical enough. If you assume that Verizon’s current spree of iPhone bashing means it’s not going to announce an Apple deal immediately, it feels more and more likely that Apple and Verizon will skip the dead-end technology an EVDO iPhone would bring and jump directly to an LTE model. And it’s going to be 2011 before an LTE iPhone makes sense.

Or so I think. I cheerfully concede that I could be wrong. Which is why this post isn’t titled “No Verizon iPhone Until 2011…”

Yes Microsofties, Apple In-Store Sales May Be Down, But…

Microsofties could barely contain their glee when this video made the rounds of the Internet over the weekend. As you can see, it shows a tale of two stores: the Mission Viejo Apple store practically barren while the Microsoft Store in that mall (yes, the one with the dancing employees) is buzzing with activity.

Some of us probably brushed this off as an isolated incident, as Apple really does not have a blockbuster product this holiday season to draw the crazed Black Friday masses in. But according to Piper Jaffray Apple analyst Gene Munster, his research is showing that slowness at Apple Stores may have actually been the norm.

About 8.3 Macs per hour were sold at retail that day at stores visited by Munster’s team, well down from the 13 per hour rate last year. However, it would be fair to note that Best Buy’s Apple “store-within-a-store” has expanded significantly and a few more Apple Stores have opened since last year.

(Some of Apple’s partners were also offering much better discounts on Apple products than the company was, too…)

Before Redmond starts dancing in the streets, take this into account. Analysis of Apple’s online store performance shows 39 percent year over year growth in sales. This outperformed the entire e-commerce sector by three times. Munster says that this online jump should be more than enough to offset any losses at retail.
